Cambodia Criminal Procedure Reform: Justice Ministry Advances Legal Revisions to the Criminal Procedure Code

Background

A Ministry of Justice technical working group is responsible for preparing revisions to the Criminal Procedure Code. The working group functions as a platform to examine draft procedural text, coordinate technical input from judicial and prosecutorial stakeholders, and prepare amendments for higher-level consideration.

On 9 July 2026 the working group’s 49th meeting reviewed Articles 292–298 of the Criminal Procedure Code with participation from Japan International Cooperation Agency (JICA) experts. The session was co-chaired by Nhean Vanna and Tang Sunlay and included deputy co-chairs, group members, and technical advisers.

Scope of Application

The review process targets the Criminal Procedure Code and its procedural provisions that govern the conduct of criminal investigations and court proceedings. Revisions emerging from the working group would apply to judicial officers, prosecutors, defence counsel, and law enforcement agencies that implement procedural rules.

Key Provisions or Decisions

The meeting examined Articles 292–298 of the code; the publicly posted summary lists the review of those articles but does not provide the text of proposed amendments or record final decisions. Participation by JICA indicates the inclusion of external technical advice during the review, while co-chairs and working-group members led substantive discussions on the cited articles.

Implications for Investors, Businesses, or Compliance

Amendments to criminal procedure can influence legal certainty in investigations and prosecutions that involve corporate actors, particularly in areas such as evidence handling and procedural timelines. Businesses and compliance teams in Cambodia should monitor the working group’s outputs to adapt policies for responding to criminal inquiries and safeguarding legal rights during procedural changes.
