Cambodia Regulatory Framework: Senate Reviews Draft Laws on Aviation Convention and ASEAN Mutual-Recognition Agreements

Background

Specialized committees of the Senate carry out technical scrutiny of draft laws and consolidate committee-level opinions for transmission to the Senate standing committee or plenary. Senate committees consolidate technical and political views on draft laws and prepare reports for the Senate’s standing committee or plenary session.

The recent internal meeting brought together the Senate Committee on Foreign Affairs, International Cooperation and Information (Committee 5) and Committee 9 to review four draft laws that concern international treaty approval and ASEAN mutual-recognition arrangements. Mutual recognition arrangements under ASEAN establish frameworks for reciprocal acceptance of specified product standards, certifications, or professional qualifications among member states.

Scope of Application

The committee review covers four draft laws submitted for Senate consideration and reporting:

1. Draft law approving Cambodia’s consent to become a party to the convention on international interests in mobile equipment and the protocol concerning matters specific to aircraft equipment.
2. Draft law approving Cambodia’s consent to an ASEAN framework agreement on mutual recognition arrangements.
3. Draft law approving ASEAN mutual-recognition arrangements for building materials and construction-related products.
4. Draft law approving ASEAN mutual-recognition arrangements on specified types of approval/certification for motor vehicle products.

Key Provisions or Decisions

Committee 5 and Committee 9 met internally to compile and reconcile their respective comments and technical assessments on the four draft laws. The consolidated opinions are to be forwarded to the Senate’s standing committee or the plenary session for further consideration and decision according to the Senate’s legislative review procedures.

Implications for Investors, Businesses, or Compliance

If enacted through the regular legislative process, the draft laws would provide a domestic legal basis for Cambodia to implement the relevant international instruments or ASEAN MRAs. Approval of the ASEAN mutual-recognition frameworks creates the statutory authorization for competent national authorities to apply reciprocal recognition mechanisms for the specified product categories or certifications.
