Cambodia Cybercrime Regulation: Police Enforce Anti-Technology-Fraud Law on WhatsApp Account Takeovers

Background

The National Police’s Department for Combating Technology Crime is the operational unit tasked with investigating unauthorized access to digital communication accounts and the fraudulent use of bank accounts in Cambodia. The department conducts criminal inquiries, gathers forensic evidence, and forwards case files to prosecutors for court action.

Article 5 of the Law on Combating Fraud via Technological Means defines the offense of technology-enabled fraud and prescribes criminal penalties for persons who use electronic platforms to commit deception. Under the legal framework, prosecutors and courts may order provisional detention and remand when suspects are charged under the statute.

Scope of Application

The law and enforcement actions apply to individuals and networks that use digital platforms—including messaging applications—to gain unauthorized control of accounts, impersonate third parties, or employ falsified bank-account details to commit fraud. Investigations under this scope can address both domestic perpetrators and cross-border actors when the conduct affects victims in Cambodia.

Key Provisions or Decisions

On the basis of directives issued by senior police leadership on 11 May 2026, the Department for Combating Technology Crime opened an investigation into a scheme involving WhatsApp account takeovers and fraudulent use of bank accounts. Investigators reported a total alleged loss to victims of USD 253,999.89 and identified sales of more than 20 bank accounts linked to the fraud network.

Authorities arrested six suspects: one Vietnamese national (male) and five Cambodian nationals (including two women). The department completed a case file and referred it to the Phnom Penh Municipal Court prosecutor; the municipal court ordered provisional detention at Prey Sar Correctional and Educational Center No. 1 and charged the suspects under Article 5 of the anti-technology-fraud law.

Banks and payment service providers should treat technology-enabled account takeover and the sale of bank accounts as credible fraud risks that require strengthened account-security measures and transaction monitoring. Companies operating messaging platforms and digital services may need to coordinate with law enforcement on incident reporting and preservation of digital evidence when fraudulent activity involves their systems.
