Cambodia Local Governance Regulation: National Assembly Amends Commune and Sangkat Administration Law

Background

The National Assembly revised the statutory framework that governs commune and sangkat administration, the primary tier of local government responsible for community-level public services and local administration. The draft law amends Articles 33, 34, 35 and 38 of the Commune and Sangkat Administration Law enacted by Royal Kram No. នស/រកម/០៣០១/០៥ on 19 March 2001.

The amendments aim to ensure that leadership positions at commune and sangkat level correspond to electoral results and democratic principles, and to strengthen unity, coherence, integrity and accountability in local administration. The National Assembly approved the draft unanimously, recording 110 votes in favour out of 110 members present.

Scope of Application

The enactment applies to the legal regime governing commune and sangkat administrative structures and leadership appointments under the 2001 law. Changes to the specified articles affect statutory rules that determine how local executive roles and administrative responsibilities are defined at the commune and sangkat level.

Key Provisions or Decisions

The approved draft law modifies four specific articles (33, 34, 35 and 38) of the existing Commune and Sangkat Administration Law. The stated objectives of these changes include aligning the designation of local leadership posts with electoral outcomes and reinforcing institutional arrangements intended to improve administrative performance and accountability at the subnational level.

Implications for Investors, Businesses, or Compliance

Organizations that interact with commune or sangkat administrations should reference the revised statutory text when assessing local administrative authority and points of contact. The legal amendments alter the formal governance framework at the commune and sangkat tier and therefore are relevant to compliance, permitting, and community engagement processes that depend on local administrative leadership.
