Cambodia Legal Regulation: National Assembly Sets Vote on Military Service and Electricity Guarantee

Background

Parliamentary approval is the central legal step for converting government-backed draft legislation into binding law in Cambodia. The National Assembly of Cambodia is the legislative institution responsible for debating and adopting draft laws before they can proceed through the constitutional lawmaking process. An extraordinary session of the National Assembly is a formal parliamentary sitting convened outside the ordinary schedule to consider specific agenda items.

Military service legislation establishes the legal basis for determining who must serve, how long service lasts, and what exemptions or penalties apply. A statutory conscription framework affects defense administration because it defines eligibility, service duration, deferments, exemptions, benefits, and sanctions within a national legal system.

Electricity payment guarantees are part of public financial and energy governance when the state supports obligations connected to power supply. Government payment guarantees for electricity supply contracts can be used to support cross-border power procurement by assuring the seller that payment obligations will be honored.

Scope of Application

The National Assembly Standing Committee decided on 8 May 2026 to convene an extraordinary session of the seventh legislature on Tuesday, 12 May 2026. The session was scheduled to debate and adopt two draft laws: the Draft Law on Military Obligation and the Draft Law Approving the Royal Government’s Payment Guarantee to Vietnam Electricity.

According to the National Assembly statement, the Draft Law on Military Obligation would apply to Cambodian men aged 18 to 25, including dual nationals residing in Cambodia, and would require 24 months of military service. Women would not be subject to compulsory service under the draft, but would be encouraged to participate voluntarily.

The draft payment-guarantee law concerns the Royal Government’s guarantee to Vietnam Electricity. The stated purpose is to support electricity supply stability, maintain reasonable electricity prices, and replace an expiring guarantee letter before 30 July 2026.

Key Provisions or Decisions

The Standing Committee set the parliamentary timetable after specialist committees reviewed the draft laws with government representatives. On 4 May 2026, an inter-commission group led by Kep Chuktema, Chair of the Fourth Commission, discussed the military obligation draft with Tea Seiha, Deputy Prime Minister and Minister of National Defence.

The National Assembly statement identified several core elements of the military obligation draft. These include compulsory 24-month service for Cambodian men aged 18 to 25, voluntary participation for women, exemptions for Buddhist monks, religious clergy, persons with disabilities, and high-level specialists carrying out important national missions.

The statement also said the draft includes commitments to transparent and fair implementation, benefits for persons completing service, and penalties for evasion. Listed benefits include employment-priority treatment, retention of position and salary for persons already employed, and the right to continue education. Persons evading the obligation could face fines and imprisonment from six months to five years, according to the draft provisions described by the National Assembly.

For the electricity guarantee draft, the Second and Ninth Commissions, led by Cheang Vun and Nin Saphon, met on 6 May 2026 with Keo Rottanak, Minister of Mines and Energy. The National Assembly statement said the draft guarantee is intended to prevent power interruptions as demand increases, keep electricity prices reasonable for household living costs, and continue Cambodia’s international payment-guarantee obligation through a new guarantee letter.

Implications for Investors, Businesses, or Compliance

The military obligation draft would create direct compliance relevance for Cambodian men in the stated age group if adopted. Employers, education providers, and public-sector recruitment bodies may need to account for service completion, job retention, salary continuity, and study-continuation rights as described in the draft.

The electricity guarantee draft has relevance for energy-sector planning because it addresses payment assurance connected to imported electricity supply. For businesses and investors using electricity-intensive operations, parliamentary approval of the guarantee would be part of the legal framework supporting continuity of power procurement from Vietnam Electricity.

Both draft laws remain subject to National Assembly deliberation and adoption during the scheduled extraordinary session. The National Assembly’s action is a legislative scheduling and review step, not an announcement that the draft laws have already entered into force.
