Background
The Ministry of Justice convenes a technical working group to draft and edit proposed changes to the national Criminal Code as part of an ongoing reform process. A Ministry of Justice technical working group is mandated to prepare revisions to the Cambodian Criminal Code.
On 7 August 2026 the group held its 45th session to continue reviewing draft provisions related to conditional release. The working group examined statutory text on conditional release, including eligibility criteria, supervisory obligations, revocation procedures, and legal consequences.
Scope of Application
The revisions under review apply to Criminal Code provisions that govern conditional release mechanisms. The scope covers statutory language setting out who qualifies for conditional release, the duties or conditions attached to release, procedures for withdrawing release, and the legal consequences of not executing withdrawal decisions.
Key Provisions or Decisions
At its 45th meeting the technical team continued to edit and refine draft articles addressing four main elements:
- Conditions for granting conditional release;
- Obligations and duties that must be fulfilled when conditional release is granted;
- Procedures and grounds for withdrawing or revoking conditional release decisions;
- Legal consequences and remedies related to failures to withdraw conditional release decisions when applicable.
Implications for Compliance and Administration
The draft changes focus on clarifying procedural and substantive elements that define compliance obligations for legal practitioners and correctional administrators. Clearer statutory language on eligibility, supervisory duties, and revocation mechanics will be the primary reference points for future implementation guidance and court or administrative decision-making once amendments are enacted.
