Cambodia Criminal Code Reform: Ministry of Justice Reviews Sentencing, Incarceration and Conditional Release Rules

Background

The Ministry of Justice technical working group is the inter-ministerial body charged with preparing amendments to the Criminal Code and related legal instruments. The Ministry of Justice convened the group’s 39th meeting on 15 May 2026 to continue revising Criminal Code provisions.

The working group’s agenda covered sentencing provisions, forms and conditions of custodial confinement, procedures and measures for conditional release, and statutory obligations during probation. His Excellency Phov Somphi, co-head of the technical working group, chaired the session attended by deputy heads and member experts from the working group.

Scope of Application

The draft provisions under review relate to statutory sentencing rules and the administration of custodial sentences under Cambodia’s Criminal Code. The scope includes legal rules that determine the form of imprisonment, conditions applicable within prison regimes, procedural elements for conditional release, and required duties for persons placed on probation.

Key Provisions or Decisions

The meeting continued to examine, discuss and amend draft legal text concerning: sentencing classifications and declaration of punishment; formats and conditions for custodial confinement within residential detention facilities; statutory mechanisms and measures tied to conditional release; and duties and obligations during probationary periods. The working group engaged in clause-level review and redrafting rather than issuing final enactment instruments at the session.

Implications for Compliance and Administration

Amendments to sentencing and conditional release provisions would alter the statutory framework that governs sentencing practice, prison administration, and probation services once adopted and promulgated. Legal practitioners, prosecutors, and correctional administrators will need to reference the revised statutory text to align sentencing submissions, custody arrangements, and probation supervision with any enacted changes.
