Background
The Law on Secured Transactions (2007) establishes a legal framework for creating and enforcing security interests over movable property in Cambodia. SETFO is an online registry administered through a Ministry of Commerce portal that records notice filings of security interests to provide public notice and creditor priority. SETFO 2.0 provides electronic filing of notice letters for secured transactions.
The Ministry of Commerce, in cooperation with the Techo Centre of the Ministry of Economy and Finance, organized a training session on 25 May 2026 that addressed implementation and practical use of the law and the SETFO system. A total of 170 participants representing 65 banks and financial institutions attended the training to review registration procedures, rights and duties under the law, and operational functions within the SETFO platform (https://setfo.moc.gov.kh).
Scope of Application
The Law on Secured Transactions (2007) and the SETFO registry apply to secured transactions that use movable assets as collateral and to entities that create, register, or take security interests over such assets. The training materials covered the law’s treatment of types of movable collateral, the establishment of security interests, and the procedural steps for filing notice letters in the SETFO system.
Key Provisions or Decisions
Presentations and modules during the training covered the following topics as set out by the Ministry of Commerce and the Techo Centre:
- Overview of the Law on Secured Transactions (2007)
- Types of collateral subject to security (movable property)
- Rights, duties, and contractual arrangements between debtors and secured parties
- Registration formalities, and rules on priority and perfection of security interests
- Mechanisms for exercising secured party rights and enforcement steps under the law
- Functional features and user procedures for SETFO 2.0 (electronic notice filing)
- Practical demonstrations of core SETFO functions for registrants and creditors
- Discussion on development of the supporting legal and institutional framework
Implications for Investors, Businesses, or Compliance
Use of a publicly accessible registry for notice filings clarifies priority among creditors and creates a single point for searching existing security interests. Financial institutions and businesses that extend or take secured credit will need operational processes to prepare, file, and monitor SETFO notices to maintain priority and comply with registration formalities. The training aimed to build capacity among bank and finance staff to use SETFO 2.0 and to interpret key procedural and enforcement provisions under the law.
