Cambodia Trust Regulation: FATCA Compliance and Investor Protection in the Trust Sector

Background

The Trust Regulator administers oversight, supervision and sector development for financial and public trusts in Cambodia, including licensing and technical guidance for trustees and trustee operators. The Trust Regulator organised an awareness session on 14 August 2026 aimed at strengthening operational understanding among trust-sector service providers.

The FATCA Agreement between the Royal Government of Cambodia and the United States, signed on 14 September 2015, establishes reporting obligations for Cambodian financial institutions and trust service providers to support international tax compliance. The workshop focused on the application of FATCA-related reporting requirements and the roles of trustees and trustee operators in meeting those obligations.

On 14 August 2026 the Trust Regulator hosted an awareness-raising workshop held at the Non-Bank Financial Services Authority meeting room (2nd floor). H.E. Sok Dara, Director General of the Trust Regulator, presided over the session and a representative of the General Department of Taxation participated as a guest speaker. Attendees included management and technical staff from the Trust Regulator and the General Department of Taxation, trustees of financial and public trusts, trustee operators providing escrow and safeguard-keeping services, valuation firms, and audit service providers active in the trust sector.

Compliance Implications

The event sought to clarify FATCA-related reporting duties and practical compliance steps for trust-sector entities, reinforcing the need for trustees and trustee operators to align client identification and recordkeeping with international tax reporting requirements. Participants were briefed on the FATCA Agreement’s objective to improve international tax compliance and on institutional coordination between tax and trust regulatory authorities in implementing reporting processes.

Institutional Role

The Trust Regulator leads capacity building and sector-specific guidance for trust service providers, while the General Department of Taxation provides tax administration expertise relevant to cross-border reporting. Coordination between the two agencies supports implementation of Cambodia’s obligations under the bilateral FATCA Agreement without creating new regulatory instruments in this event.
